营口市新型墙体材料专项基金征收和使用管理实施细则
第一章 总则
第一条 为大力推广新型墙体材料,规范新型墙体材料专项基金收支管理,根据财政部、国家经贸委《新型墙体材料专项基金征收和使用管理办法》、《辽宁省新型墙体材料开发应用管理规定》、省财政厅、省墙改办《辽宁省新型墙体材料专项基金征收和使用管理实施细则》等有关规定,结合我市实际,制定本细则。
第二条 本细则所称新型墙体材料是指除用粘土或者掺粉煤灰等工业固体废物烧结的实心砖以外的具有保温隔热、轻质高强的建筑墙体材料。
第三条 在我市行政区域内征收和使用管理新型墙体材料专项基金(以下简称墙材基金)适用本细则。
第四条 墙材基金属于政府性基金,收入全额缴入国库,纳入财政预算,实行收支两条线管理,专款专用,年末结余可结转下年度使用。
第五条 市、市(县)区财政部门和墙体材料改革行政主管部门(以下统称墙改部门)负责组织实施本细则。财政部门是墙材基金的征收主体,财政部门可委托同级墙体材料革新与建筑节能领导小组办公室征收墙材基金。
第六条 墙材基金的征收和使用管理应当接受财政、审计、规划建设行政主管部门和上级墙改部门的监督检查。
第二章 征收管理
第七条 凡在我市行政区域内新建、改建、扩建的建筑工程,建设单位开工前必须到所在地墙改部门办理备案手续,按照有关部门确定的建筑面积以每平方米8元的标准预缴墙材基金。已备案的工程如果墙体保温、屋面保温、门窗保温等设计文件发生改动,应当重新到所在地墙改部门登记备案。建设、施工单位在施工过程中应当接受墙改部门对墙体材料使用及建筑节能施工情况的监督。
未按照规定缴纳墙材基金的建筑工程,规划建设行政主管部门不予发放建筑工程施工许可证,不予办理建筑工程开工手续。
第八条 建筑工程主体完工后30日内,建设单位凭新型墙体材料使用和具有建筑节能检测资质的机构出具的建筑节能证明材料向所在地墙改部门提出墙材基金返退申请,由所在地墙改部门会同财政部门按照以下规定办理墙材基金清算手续:
(一)全部使用新型墙体材料并达到节能65%标准的民用建筑及全部使用新型墙体材料的其他建筑,100%返退预缴的墙材基金;
(二)全部使用新型墙体材料未达到节能65%标准的民用建筑,按照实际建筑面积的80%返退预缴的墙材基金;
(三)未全部使用新型墙体材料的建筑工程,新型墙体材料用量在60%以上,按照新型墙体材料实际用量比例的50%返退预缴的墙材基金;
(四)使用新型墙体材料用量未达到60%的建筑工程,不予返退预缴的墙材基金。
市墙改部门会同有关部门定期公布符合标准的新型墙体材料产品及生产企业。
第九条 建设单位缴纳的墙材基金计入建筑安装工程成本,预缴的墙材基金返退部分冲抵工程成本。
第十条 各市(县)区墙改部门将当年征收的墙材基金净额的20%上缴市墙改部门(其中10%为上缴省墙改部门的墙材基金)。市墙改部门将市本级当年征收的墙材基金净额的10%及各市(县)区墙改部门应上缴省墙改部门的墙材基金一并上缴省墙改部门。
第十一条 市和市(县)区墙改部门将征收的属于本级财政收入的墙材基金全额上缴同级财政部门,并纳入地方财政预算管理。各级财政部门负责监督同级墙材基金的收缴和入库工作。
第十二条 征收墙材基金,应当使用省级财政部门统一印制的专用票据。
第十三条 任何单位和个人不得擅自改变墙材基金征收对象,扩大征收范围,提高或者降低征收标准;不得向施工单位重复收取墙材基金,也不得在墙体材料销售环节征收。
第十四条 墙材基金代征手续费按实际代征缴入国库2‰的比例由同级财政部门按规定计提和拨付,并纳入地方预算管理。
第三章 使用管理
第十五条 墙材基金使用范围:
(一)引进、新建、扩建、改造新型墙体材料生产线工程项目的贴息;
(二)新型墙体材料示范项目(含引进项目)和推广应用试点工程的补贴;
(三)新型墙体材料的科研、新技术与新产品开发及推广;
(四)发展新型墙体材料的宣传;
(五)代征手续费;
(六)经同级财政部门批准与发展新型墙体材料有关的其他开支。
第十六条 墙材基金用于固定资产投资和更新改造的,作为增加国家资本金处理。
第十七条 市和市(县)区墙改部门的经费由同级财政部门按照基本支出预算和项目支出预算从墙材基金中拨付。
第十八条 市和市(县)区墙改部门应按同级财政部门规定编制年度墙材基金预算决算,报同级财政部门审批,并报同级建设行政主管部门备案。
第十九条 墙材基金用于新型墙体材料基本建设工程项目或技术改造项目的,按照下列程序办理:
(一)使用单位提出书面申请及项目建设可行性报告;
(二)所在地墙改部门组织专家组对项目可行性报告进行审查,市(县)区墙改部门应将审查结果报市墙改部门备案;
(三)基本建设、技术改造项目和科研开发项目,应按国家规定的审批程序和管理权限办理;
(四)经所在地墙改部门审核后,报同级财政部门审批,纳入墙材基金年度预算;
(五)财政部门根据墙材基金年度预算拨付项目资金。
第四章 法律责任
第二十条 建设单位不及时足额缴纳墙材基金的,由所在地墙改部门责令补缴墙材基金,并自滞纳之日起按日加收应缴墙材基金万分之五的滞纳金。
第二十一条 建设单位虚报建筑面积及新型墙体材料购进数量,由所在地墙改部门责令改正,并限期补缴应缴的墙材基金。
第二十二条 各级墙改部门不按本细则征收墙材基金,不按规定使用省财政部门统一印制的政府性基金专用票据,截留、挤占、挪用墙材基金的,由同级财政部门或者上级财政、墙改部门责令改正,并按照有关法律、法规的规定进行处罚。市(县)区当年征收的墙材基金净额不按本细则规定足额上缴、不按规定比例使用墙材基金的,由市财政部门、墙改部门责令改正。
第二十三条 对违反本细则规定的行政主管部门、建设单位以及其他单位主要负责人及直接责任人员,依照有关法律、法规规定,给予行政处分或处罚;构成犯罪的,移交司法机关依法处理。
第五章 附 则
第二十四条 本细则发布之日前获得土地使用权(以合同签订日期为准),其土地出让金中含墙材基金的,经所在地墙体材料改革行政主管部门核定,可按原规定执行;土地出让金中不含墙材基金的,按本细则执行。
第二十五条 本细则自发布之日起实施。营口市人民政府1995年4月5日发布的《营口市发展新型墙体材料和节能建筑暂行规定》(营政发〔1995〕10号)同时废止;营口市人民政府2003年3月11日发布的《营口市房地产开发优惠政策及收费标准》(营政发〔2003〕13号)附件1第二项免收“墙改基金”同时失效。

新型墙体材料目录
一、非粘土砖
(一)孔洞率大于25%非粘土烧结多孔砖和空心砖(符合国家标准GB13544—2000和GB13545—1992的技术要求)。
(二)混凝土空心砖和空心砌块(符合国家标GB13545—1992的技术要求)。
(三)烧结页岩砖(符合国家标准GB/T5101—1998的技术要求)。
二、建筑砌块
(一)普通混凝土小型空心砌块(符合国家标准GB8239—1997的技术要求)。
(二)轻集料混凝土小型空心砌块(符合国家标GB15229—1994的技术要求)。
(三)蒸压加气混凝土砌块(符合国家标准GB/T11968—1997的技术要求)。
(四)石膏砌块(符合行业标准JC/T698—1998的技术要求)。
三、建筑板材
(一)玻璃纤维增强水泥轻质多孔隔墙条板(简称GRC板,符合行业标准JC666—1997的技术要求)。
(二)纤维增强低碱度水泥建筑平板(符合行业标准JC/T626—1996的技术要求)。
(三)蒸压加气混凝土板(符合国家标准GB15762—1995的技术要求)。
(四)轻集料混凝土条板(参照行业标准《住宅内隔墙轻质条板》JC/T3029—1995的技术要求)。
(五)钢丝网架水泥夹芯板(符合行业标准JC623—1996的技术要求)。
(六)石膏墙板(包括纸面石膏板、石膏空心条板),其中:纸面石膏板(符合国家标准GB/T9775—1999的技术要求);石膏空心条板(符合行业标准JC/T829—1998的技术要求)。
(七)金属面夹芯板(包括金属面聚苯乙烯夹芯板、金属面硬质聚氨酯夹芯板和金属面岩棉、矿渣棉夹芯板),其中:金属面聚苯乙烯夹芯板(符合行业标准JC689—1998的技术要求);金属面硬质聚氨酯夹芯板(符合行业标准JC/T868—2000的技术要求);金属面岩棉、矿渣棉夹芯板(符合行业标准JC/T869—2000的技术要求)。
(八)复合轻质夹芯隔墙板、条板(所用板材为以上所列几种墙板和空心条板,复合板符合建设部《建筑轻质条板、隔墙板施工及验收规程》的技术要求)。
四、原料中掺有不少于30%的工业废渣、农作物秸秆、垃圾、江河(湖、海)淤泥的墙体材料产品(废渣烧结实心砖除外)。
五、预制及现浇混凝土墙体。
六、钢结构和玻璃幕墙。

中华人民共和国技术引进合同管理条例(附英文)

第一条 为了进一步扩大对外经济技术合作,提高我国科学技术水平,促进国民经济发展,特制定本条例。
第二条 本条例规定的技术引进是指中华人民共和国境内的公司、企业、团体或个人(以下简称受方),通过贸易或经济技术合作的途径,从中华人民共和国境外的公司、企业、团体或个人(以下简称供方)获得技术,其中包括:
(一)专利权或其他工业产权的转让或许可;
(二)以图纸、技术资料、技术规范等形式提供的工艺流程、配方、产品设计、质量控制以及管理等方面的专有技术;
(三)技术服务。
第三条 引进的技术必须先进适用,并且应当符合下列一项以上的要求:
(一)能发展和生产新产品;
(二)能提高产品质量和性能,降低生产成本,节约能源或材料;
(三)有利于充分利用本国的资源;
(四)能扩大产品出口,增加外汇收入;
(五)有利于环境保护;
(六)有利于安全生产;
(七)有利于改善经营管理;
(八)有助于提高科学技术水平。
第四条 受方和供方必须签订书面的技术引进合同(以下简称合同),并由受方在签字之日起的三十天内提出申请书,报中华人民共和国对外经济贸易部或对外经济贸易部授权的其他机关(以下简称审批机关)审批;审批机关应当在收到申请书之日起的六十天内决定批准或不批准;经批准的合同自批准之日起生效。在规定的审批期限内,如果审批机关没有作出决定,即视同获得批准,合同自动生效。
第五条 技术引进合同的签订,应当遵守《中华人民共和国涉外经济合同法》和其他法律的有关规定。
下列事项,双方应当在合同中加以明确:
(一)引进的技术的内容、范围和必要的说明,其中涉及专利和商标的应当附具清单;
(二)预计达到的技术目标以及实现各该目标的期限和措施;
(三)报酬、报酬的构成和支付方式。
第六条 供方应当保证自己是所提供的技术的合法拥有者,并且保证所提供的技术完整、无误、有效,能够达到合同规定的目标。
第七条 受方应当按照双方商定的范围和期限,对供方提供的技术中尚未公开的秘密部分,承担保密义务。
第八条 合同的期限应当同受方掌握引进技术的时间相适应,未经审批机关特殊批准不得超过十年。
第九条 供方不得强使受方接受不合理的限制性要求;未经审批机关特殊批准,合同不得含有下列限制性条款:
(一)要求受方接受同技术引进无关的附带条件,包括购买不需要的技术、技术服务、原材料、设备或产品;
(二)限制受方自由选择从不同来源购买原材料、零部件或设备;
(三)限制受方发展和改进所引进的技术;
(四)限制受方从其他来源获得类似技术或与之竞争的同类技术;
(五)双方交换改进技术的条件不对等;
(六)限制受方利用引进的技术生产产品的数量、品种或销售价格;
(七)不合理地限制受方的销售渠道或出口市场;
(八)禁止受方在合同期满后,继续使用引进的技术;
(九)要求受方为不使用的或失效的专利支付报酬或承担义务。
第十条 合同报批必须提交下列文件:
(一)报批申请书;
(二)合同副本和合同译文文本;
(三)签约双方法律地位的证明文件。
第十一条 修订合同或延长合同期限,都应当比照本条例第四条、第十条的规定办理。
第十二条 本条例由对外经济贸易部负责解释;施行细则由对外经济贸易部制定。
第十三条 本条例自发布之日起施行。

REGULATIONS OF THE PEOPLE'S REPUBLIC OF CHINA ON ADMINISTRATION OF
TECHNOLOGY-INTRODUCTION CONTRACTS
(Promulgated by the State Council on May 24, 1985)
Article 1
These Regulations are formulated with a view to further expanding foreign
economic and technological cooperation, upgrading the scientific and
technological level of the country and promoting the national economic
growth.
Article 2
Introduction of technology referred to in these Regulations means
acquisition of technology by any corporation, enterprise, organization or
individual within the territory of the People's Republic of China
(hereinafter referred to as the recipient) from any corporation,
enterprise, organization, or individual outside the territory of the
People's Republic of China (hereinafter referred to as the supplier), by
means of trade or economic and technical cooperation, such as:
1. assignment or licensing of patent or other industrial property rights;
2. proprietary technology provided in the forms of drawings, technical
data, technical specifications, etc, such as technological processes,
formulae, product designs, quality control and management skills;
3. technical services.
Article 3
The technology to be introduced must be advanced and appropriate and shall
at least conform to one of the following requirements:
1. capable of developing and producing new products;
2. capable of improving quality and performance of products, reducing
production cost and lowering consumption of energy or raw materials;
3. favourable to maximum utilization of local resources;
4. capable of expanding product export and increasing earnings of foreign
exchange;
5. favourable to environmental protection;
6. favourable to production safety;
7. favourable to improvement of management;
8. contributing to advancement of scientific and technical level.
Article 4
The recipient and the supplier shall conclude in written form a
technology-introduction contract (hereinafter referred to as the
contract). An application for examination and approval of the contract
shall be submitted by the recipient, within days from the date of
conclusion, to the Ministry of Foreign Economic Relations and Trade of the
People's Republic of China or to any other agency authorized by the
Ministry (hereinafter referred to as the examining and approving
authorities). The examining and approving authorities shall decide to
approve or disapprove the contract within 60 days from the date of
receipt. An approved contract shall come into effect as of the date of
approval. Contracts on which the examining and approving authorities does
not make a decision within the specified period of time shall be regarded
as approved and shall come into effect automatically.
Article 5
The conclusion of technology-introduction contracts must comply with the
relevant provisions of the Law of the People's Republic of China on
Economic Contracts Involving Foreign Interest and other laws.
The contracting parties must specify in the contract the following items:
1. contents, scope and essential description of the technology to be
introduced, and a list of patents and trademarks if they are involved;
2. technical targets to be attained and the time limit and measures for
attaining the targets; and
3. remuneration, composition of remuneration and modes of payment.
Article 6
The supplier shall ensure that it is the lawful owner of the technology to
be provided and that the technology provided is complete, accurate,
effective and capable of attaining the technical targets specified in the
contract.
Article 7
The recipient shall undertake the obligation to preserve, in accordance
with the scope and duration agreed upon by both parties, the non-open
technical secrets contained in the technology provided by the supplier.
Article 8
The duration of the contract shall conform to the time needed by the
recipient to assimilate the technology provided and, unless specially
approved by the examining and approving authorities, shall not exceed ten
years.
Article 9
The supplier shall not oblige the recipient to accept requirements which
are unreasonably restrictive. Unless specially approved by the examining
and approving authorities, a contract shall not include any of the
following restrictive provisions:
1. requiring the recipient to accept additional conditions which are not
related to the technology to be introduced, such as requiring the
recipient to purchase unnecessary technology, technical service, raw
materials, equipment or products;
2. restricting the freedom of choice of the recipient to obtain raw
materials, parts and components or equipment from other sources;
3. restricting the development and improvement by the recipient of the
introduced technology;
4. restricting the acquisition by the recipient of similar or competing
technology of the same kind from other sources;
5. non-reciprocal terms for exchange of improved technology between the
contracting parties;
6. restricting the quantity, variety or sales price of products to be
turned out by the recipient with the technology acquired;
7. unreasonably restricting the sales channels or export markets of the
recipient;
8. forbidding the continued use by the recipient of the acquired
technology after expiration of the contract; and/or
9. requiring the recipient to pay for or to undertake obligations for
patents which are unused or no longer effective.
Article 10
In applying for approval of a contract, the following documents shall be
submitted:
1. a written application for approval of the contract;
2. copies of the contract and its translation; and
3. documents certifying the legal status of the contracting parties.
Article 11
Any revision or renewal of a contract shall be in accordance with the
provisions stipulated in Article 4 and Article 10 of these Regulations.
Article 12
The authority to interpret these Regulations and to formulate the rules
for implementing these Regulations resides in the Ministry of Foreign
Economic Relations and Trade.
Article 13
These Regulations shall enter into force as of the date of promulgation.
